  1. General Terms and Conditions of Vesela Dimova e.U.

    1. GENERAL
      The subject of these terms and conditions are all offers and services provided by Vesela Dimova e.U., regardless of the location, time, and duration of the execution, unless otherwise stipulated in the respective contracts. By using an offer or service, the customer accepts these terms and conditions without reservation.

    2. USAGE RIGHTS
      All services from Vesela Dimova e.U. are generally open to all interested parties. However, there is no legal claim to the use of services. If specific personal conditions are required for a particular service, these must be met by the customer. Vesela Dimova e.U. reserves the right to refuse interested parties without giving reasons before the service is provided, or to terminate the contract due to non-fulfillment of participation requirements.

    3. RIGHT OF WITHDRAWAL
      You have the right to withdraw from this contract within fourteen days without providing any reason. The withdrawal period is fourteen days from the day of the contract conclusion. To exercise your right of withdrawal, you must inform me, Vesela Dimova e.U. / Vesela Dimova, Linzer Straße 80/3/4, 1140 Vienna, email: contact@veseladimova.com, via a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. To comply with the withdrawal deadline, it is sufficient for you to send the withdrawal notification before the deadline expires.

    CONSEQUENCES OF WITHDRAWAL
    If you withdraw from this contract, I will refund all payments I have received from you, including delivery costs (except for additional costs arising from choosing a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day I receive your withdrawal notice. I will use the same payment method for the refund that you used in the original transaction unless we have explicitly agreed otherwise; in no case will you be charged fees for this refund.

    1. CONDITIONS FOR THE USE OF SERVICES BY Vesela Dimova e.U.
      The following conditions apply to all offers provided by Alkemy.

    4.1 Requirements
    Each customer confirms upon registration that they are physically healthy, mentally stable, and capable of meeting the physical and mental demands of the services offered. The offered services are not to be considered as therapeutic or healing programs and do not replace medical care or prescriptions. In case of doubt, a doctor should be consulted.

    4.2 Registration
    Registration for services from Vesela Dimova e.U. must be made in writing via email, and the customer will receive a confirmation email. This will secure the place and make the participation fee due for payment. Registrations will be considered in the order they are received. With the confirmation email, the contract becomes legally binding. If a registration cannot be considered, the interested party will be informed immediately. Only registrations from adults will be accepted. Minors will be represented by their parents.

    4.3 Payment Terms
    The participation fee is due before the event begins. The participation fee is due upon registration and must be transferred without delay to the provided bank account. A delay in payment occurs if the fee is not paid within a set period. Any processing and legal fees due to late payments will be borne by the customer. In case of payment delay, Alkemy has the right to withdraw from the contract and assign the course spot to another person.

    4.4 Participation Obligation, Exclusion
    Participants are required to attend the courses (or other booked events like training) regularly and constructively. Absences or the decision to discontinue a booked offer are solely the responsibility of the participant and do not entitle them to a refund of the participation fee.

    4.5 Arrival at Workshop/Seminar/Training
    Vesela Dimova e.U. opens 15 minutes before the event begins. It is requested to arrive on time to avoid disturbing the other participants. Entry is only allowed before the course begins. There is no right to join a session that has already started.

    4.6 Cancellation of Registration, Withdrawal Conditions
    Cancellations will only be accepted in writing (via email) and confirmed in writing. No cancellation fee is charged if the registration is canceled up to 2 weeks before the event date (workshops/group courses). For cancellations within 14 to 7 days before the event start (workshops/group courses), a processing fee of 50% of the invoice amount will be charged. For cancellations less than 7 days before the event (workshops/group courses), the entire participation fee will be charged. This also applies if the participant simply does not show up without timely cancellation. If it is necessary to collect the course fee through a reminder, additional reminder fees (€7 per booked course) and registration fees (€2.70) will be charged. A substitute participant can be provided at any time, which replaces the cancellation fee.

    4.7 Cancellation of Private Lessons
    Agreed appointments for private lessons are binding. If they are not canceled at least 24 hours in advance, the full amount must be paid.

    4.8 Conducting Events, Cancellation, Interruption, Changes
    To maintain a high-quality standard for yoga classes, courses, seminars, and workshops, the number of participants is limited. The execution of a course/workshop depends on reaching a minimum number of participants by a specific date. If the number of registrations is lower, the course/workshop may be changed, rescheduled, or canceled. Already paid participation fees will be refunded in full, or the customer may request a transfer to another course/workshop. Additional compensation claims are excluded. Vesela Dimova e.U. reserves the right to postpone, interrupt, or cancel a course session or a whole course for an important reason. In case of cancellation or postponement, already paid fees will be refunded in full, or in case of interruption, proportionately. If an entire course is affected, an optional transfer can be made upon the customer’s request. Further damage claims are excluded.

    4.9 Liability of Vesela Dimova e.U.
    The liability of Vesela Dimova e.U. for personal injury, property damage, and financial loss is limited to intent and gross negligence. Vesela Dimova e.U. is not liable for the consequences of incorrectly performed exercises. Liability for loss of clothing, valuables, or money brought by the customer is also excluded. The use of services provided by Vesela Dimova e.U. is at the customer’s own risk. Vesela Dimova e.U. is released from any liability claims and is not responsible for accidents or resulting physical injuries. Each customer confirms upon registration that they have personal liability and accident insurance. Vesela Dimova e.U. is committed to performing services professionally and diligently according to proper execution principles, ensuring the accuracy and completeness of the information provided. However, no warranty for the currentness, correctness, completeness, or quality of the provided information can be assumed. Claims for damages against Vesela Dimova e.U. due to material or immaterial damages resulting from the use or non-use of the information provided are generally excluded unless there is proven intent or gross negligence on the part of Vesela Dimova e.U.

    4.10 Health Condition of Participants
    Participants confirm they are not suffering from any contagious diseases and that there are no medical reasons preventing them from performing the yoga exercises. Chronic diseases, musculoskeletal conditions, or other physical or mental conditions that could affect their practice must be disclosed to the instructor before the session. Pregnancy must also be disclosed to the instructor before the session.

      1. Retreats: Special Registration and Cancellation Rules
        5.1 Reservation Deposit
        • A non-refundable deposit of 20% of the total retreat cost is required to confirm your reservation.
        • Your reservation is only confirmed once the deposit has been received.

      5.2 Full Payment
      • The full amount is due 60 days before the start of the retreat.
      • Failure to complete the payment by the due date may result in the loss of your reservation and deposit.

      5.3 Payment Plans
      • Payment plans are available upon request and must be agreed upon at the time of booking.
      • All installments must be fully paid by the final payment deadline.

      5.4 Accepted Payment Methods
      • Payments can be made by bank transfer, credit/debit card, PayPal, or other specified methods.
      • All transaction fees incurred during payment are the responsibility of the participant.

      5.5 Late Payments
      • Late payments may incur a [X %] late fee or may result in the loss of your reservation, at the discretion of the organizer.

      5.6 Currency and Exchange
      • All prices are in Euros. If payment is made in another currency, the participant bears the risk of exchange rate fluctuations and any additional conversion fees.

      5.7 Cancellation by the Participant
      • More than 90 days before the retreat starts: You will receive a 20% refund of payments made, minus the non-refundable deposit.
      • Between 60 and 89 days before the retreat starts: A 50% refund of the total retreat cost will be given, minus the non-refundable deposit.
      • Less than 60 days before the retreat starts: No refund is provided.

      5.8 Cancellation by the Organizer
      • If the retreat is canceled by Vesela Dimova e.U., a full refund will be issued to the participant.
      • The organizer is not responsible for any costs or losses incurred by the participant due to retreat cancellation (e.g., travel expenses).

    1. Confidentiality, Data Protection

      Personal and company-related customer data is collected, stored, and processed in compliance with data protection regulations and will not be shared with third parties. Confidential information about the customers that becomes known during the cooperation will be treated with strict confidentiality.
      1. Final Provisions
        There are no additional agreements. Changes must be made in writing. This also applies to the written form clause. The correction of mistakes as well as printing and calculation errors is reserved. If individual provisions of the General Terms and Conditions become wholly or partly ineffective, the validity of the remaining provisions will not be affected (severability clause). In place of the wholly or partly ineffective provision, a legally permissible and appropriate provision will apply, which comes closest to the economic intent and purpose of the original provision.

      2. Applicable Law and Jurisdiction
        Austrian law applies, excluding its conflict-of-law rules. For all disputes, the court responsible for the dispute between the parties and geographically for Hall in Tyrol is exclusively competent.

      By booking a service from Vesela Dimova e.U., you accept these terms and conditions.
